Exclusive Remedy:
BY REGISTERING YOUR WARRANTY FOR YOUR ROOF YOU EXPRESSLY AGREE THAT YOU HAVE ENTERED INTO A DIRECT CONTRACTUAL RELATIONSHIP WITH PETERSEN-DEAN, INC. ("PD") AND HAVE AGREED AND ACCEPTED THE TERMS AND CONDITIONS SET FORTH BELOW WHICH MAY LIMIT OR WAIVE CERTAIN CONTRACTUAL RIGHTS YOU MAY HAVE. YOU UNDERSTAND AND AGREE THAT THE TERMS AND CONDITIONS OF THIS AGREEMENT ARE SUBJECT TO CHANGE AT ANY TIME WITHOUT NOTICE TO YOU. YOU ACKNOWLEDGE THAT PD MAKES NO REPRESENTATIONS OR PROMISES OTHER THAN THOSE CONTAINED HEREIN.

Dispute Resolution:
You agree that ALL claims, disputes, and controversies ("Claim") related in any way to your roof, your warranty, this dispute resolution clause or the validity of any agreement you may have with PD, must be resolved by binding arbitration by the American Arbitration Association. Any arbitration must take place in San Francisco, California. Judgment upon any arbitration award may be entered in any court having jurisdiction. This dispute resolution provision applies to all claims, known and unknown, in existence or that may arise, that are in any way related to your roof, your warranty, the Warranty Registration feature, or this web site. YOU AND WE AGREE TO KNOWINGLY WAIVE ALL RIGHT YOU OR WE MIGHT HAVE TO A JURY OR COURT TRIAL AND THE OPPORTUNITY TO LITIGATE CLAIMS IN COURT, BEFORE EITHER A JUDGE OR JURY OR TO PARTICIPATE IN A LAWSUIT OR BE REPRESENTED BY OTHERS IN COURT (INCLUDING CLASS ACTIONS). Any lawsuit filed by you or on your behalf against us related to your roof, your warranty, or any agreement with PD, is null and void. PD will be entitled to damages including reasonable attorney's fees if it is forced to seek dismissal of a lawsuit filed by you or on your behalf against us related to your roof, your warranty, and the Warranty Registration feature of this Web Site.

Indemnity:
You acknowledge and agree to indemnify and hold PD and its affiliates and their officers, directors, owners, employees and agents harmless from and against any loss, damage, liability, cost or expense of any kind (including reasonable attorney's fees) we may incur in connection with a third party claim related to your roof or any agreement you have with PD.
